Shoplifting Penalties
There are a variety of possible penalties in any given shoplifting (and larceny) case, depending on the extenuating circumstances involved. You need a capable New York criminal defense lawyer who can think outside the box and defend your involvement in the circumstances leading to your charges of shoplifting.
The following are some of the classifications and penalties associated with shoplifting:
- Petit Larceny: When the property value is measured at $1,000 or less, the maximum penalty includes up to one year in prison and a fine of up to $1,000.
- Grand Larceny in the fourth degree: When the property value is over $1,000 but equal to or less than $3,000, the maximum penalty includes up to four years in prison and a fine of up to $5,000, or double the offender’s gain from the shoplifting crime, whichever is greater.
- Grand Larceny in the third degree: When the property value is over $3,000 but equal to or less than $50,000, the maximum penalty includes up to seven years in prison and a fine of up to $5,000, or double the offender’s gain from the shoplifting crime, whichever is greater.
- Grand Larceny in the second degree: When the property value is over $50,000 but less than $1 million, the maximum penalty includes up to 15 years in prison and a fine of up to $5,000, or double the offender’s gain from the shoplifting crime, whichever is greater.
- Grand Larceny in the first degree: When the property value is over $1 million, the maximum penalty includes up to 25 years in prison and a fine of up to $5,000, or double the offender’s gain from the shoplifting crime, whichever is greater.
Due to the dollar amounts involved, the vast majority of shoplifting charges fall into the categories of either petit larceny or grand larceny in the fourth degree.
