What is the Statute of Limitations on Embezzlement in New York?
The statute of limitations for embezzlement in New York is usually five years. This law is because most embezzlement arrests involve grand larceny and thefts over $1,000.
New York Embezzlement Penalties
In New York, embezzlement is a form of larceny and is a property crime. Embezzlement penalties are similar to those for other kinds of larceny.
Larceny comes in five classes:
- Petit Larceny – This applies to property values up to $1,000. The maximum penalty is up to one year in prison and/or a fine of up to $1,000.
- Grand Larceny in the fourth degree – This applies to property values of more than $1,000 but equal to or less than $3,000. The maximum penalty is up to four years in prison and/or the greater of a fine of up to $5,000 or double the offender’s gain from the crime.
- Grand Larceny in the third degree – This applies to property values of more than $3,000 but equal to or less than $5,000. The maximum penalty is up to seven years in prison and/or the greater of a fine of up to $5,000 or double the offender’s gain from the crime.
- Grand Larceny in the second degree – This applies to property values of more than $50,000 but less than $1 million. The maximum penalty is up to fifteen years in prison and/or the greater of a fine of up to $15,000 or double the offender’s gain from the crime.
- Grand Larceny in the first degree – This applies to property values of more than $1 million. The maximum penalty is up to four twenty-five years in prison and/or the greater of a fine of up to $30,000 or double the offender’s gain from the crime, whichever is greater.
